By accessing and browsing on the Site, the user accepts the current terms and conditions of use (hereinafter, “T&C”); if the user does not accept it, he is required to leave the Site. Search on Media Group reserves itself the right to modify the T&C at any time, without prior notice. Consequently, the user acknowledges that the use of the Site is governed by the T&C from time to time in force at the time of the last access.

2) Content

The contents of the Site are only for informational purposes. While taking the utmost care in the maintenance of the Site and in the selection of its contents, Search on Media Group assumes no responsibility for the accuracy, completeness, and timeliness of the data and information contained therein or on related/connected websites; consequently, any liability from errors or omissions arising directly or indirectly from the use of data and information available on the Site is declined. The user is therefore obliged to personally verify the accuracy of the information contained in the Site, before taking any action. Search on Media Group reserves itself the right to make changes and corrections to the Site on its sole discretionary basis and without prior notice.

The user acknowledges that any content sent to Search on Media Group by means of the Site and/or to the addresses indicated therein does not constitute confidential material. Search on Media Group will not be required to keep confidential the information sent by the user.

The Site, considered in its entirety, as well as all the material contained therein, is subject to copyright and other intellectual property rights. The contents published or otherwise present on the Site – including, by means of example, but not limited to, the trademarks, logos, images, notices and documents generally produced therein, as well as the application software and the codes used for the implementation of the Site - are of exclusive ownership of Search on Media Group, or used with the authorization or license of the relative owner. On them Search on Media Group reserves all the rights, including reproduction rights: the user may use the above-mentioned content only if this is strictly necessary for the proper use of the Site. Any different use must be considered not allowed.

Copying and reproduction of any text on the Site and/or on other sites managed by Search on Media is not considered allowed. It must be considered forbidden any operation that allows the user to make a page of the Site (or a part of it) appear on a different page of third-party ownership by contextually ensuring that the content of the said page rather than appearing in an autonomous browser window navigation appears within a frame created for this purpose.

The security of data transmitted via Internet's own protocols can not be guaranteed with the degree of certainty. 1) Introduction

The current information to data subject concerns the data processing processed by Search On Media Group S.r.l., with headquarters in Ugo Bassi street, n. 7 Bologna (BO), telephone number 0510951294, email address: info@searchon.it, fax number 0514380944 (hereinafter the “Data Controller”), in compliance with the Regulation (EU) 2016/679 (hereinafter, “GDPR”).

The Data Controller, in fact, may process personal data relating to subjects who adhere to the initiatives and competitions linked to the WMF - We Make Future, in compliance with the respective offers to the public. The information is also accessible at the Data Controller. If expressly requested, the information indicated herein may also be provided orally, provided that the identity of the applicant is proven, by means of a telephone request.

The Data Controller is Search On Media Group S.r.l. Since the Data Controller is located in Italy, there is no need to appoint a representative.

5) Purposes of the processing and legal basis

The personal data shall be processed for the following purposes:

a) For contractual purposes and/or related to the implementation of pre-contractual measures adopted on specific requests and, in particular, to allow participation in the WMF - We Make Future initiatives, in accordance with the relevant offers to the public, which accesses this information. In this case, the need to proceed with the processing for the purpose of carrying out the contract and/or for the management of pre-contractual relationships constitutes a legal basis. In relation to personal data processed and stored for this purpose, the communication of personal data is a contractual obligation and a necessary requirement for the conduct of pre-contract negotiations and for the conclusion of the contract. The interested party has the right to provide personal data; in case of non-disclosure of such data, however, it will not be possible to conclude any contract or to carry out any contractual negotiation or to allow participation in the initiatives;

b) For purposes related to relevant legal obligations if a treatment has been carried out for the purposes referred to in letter a). In this case, the legal obligation of the Owner to process such personal data is constituted according to the applicable national law. The communication of personal data is a legal obligation. There is an obligation, in this case, to provide personal data; in case of failure to communicate such data it will not be possible to conclude the contract or to participate in the initiative.

c) To send direct marketing communications, newsletters, advertising and commercial material, through the use of traditional systems of contact and automated computer systems, including commercial or promotional communications by email or text message or for marketing survey. In this case, the data subject’s consent expressed in compliance with this information to the data subject shall provide the legal basis. The communication of personal data is not a contractual obligation, so the data subject has the right to provide personal data; however, in the event of failure to communicate such data, no marketing activity shall be carried out.

In relation to the personal data processed for the purposes referred to in point c), number 5 of this information to the data subject (marketing purposes), the processing will be carried out through the use of software that automatically sends commercial information.

Only personal data provided in compliance with this information will be processed, collected through a specific form, or data collected during the initiative that accesses this information. The collection can also take place with audiovisual media. Personal data from sources accessible to the public will not be processed.

The recipients of your personal data may be:

  • communication companies that carry out commercial communication and profiling activities on behalf of the Data Controller and are data processors;

The Data Controller may intend to transfer personal data to a third country or to an international organization. Such subjects may be:

  • Communication companies that conduct a communication activity on behalf of the Data Controller;

  • Suppliers of services for the communication company;

  • Controlled organizations and/or controllers.

The transfer of personal data to the aforementioned subjects, if based in a third country or international organization, is carried out according to a decision of suitability of the European Commission, which evaluates how the third country, the territory or one or more specific sectors in the third country or the international organization ensure an adequate level of protection of the data subject’s rights. In the absence of such decision, the Data Controller – if deemed in any case appropriate – reserves himself the right to conclude specific separate agreements that oblige such subjects to adopt adequate security and also organizational measures, in order to offer appropriate guarantees related to the data subject’s rights. In order to obtain a copy of those data or the place where they are made available it is possible to send a request to the Data Processor.

12) Personal data retention period

The personal data processed and stored for the purposes referred to in paragraphs 1) and 2) of which number 5 of this information (contractual and pre-contractual purposes and fulfillment of legal obligations) are processed for a period of time not exceeding 10 years from the termination of the effects of the contract, in case of conclusion of the contract, and, in the case of mere pre-contractual negotiations, for a period not exceeding 10 years from the termination of the negotiations, without prejudice, in any case, different law.

The personal data processed for the purposes referred to in point c) number 5 of this information to the data subject (marketing purposes) are processed and retained until the data subject does not request the cancellation thereof.

13) Right to object

The data subject has the right to object in the circumstances listed hereinbelow:

  • At any time, in relation to reasons related to your particular situation, to oppose to the processing of personal data concerning yourself, according to point (e) or (f) of Article 6(1) of the GDPR, including profiling based on those provisions. The Data Controller shall no longer process the personal data unless the Data Controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims;

  • Where personal data are processed for direct marketing purposes, you shall have the right to object at any time to the processing of personal data concerning yourself for such marketing, which includes profiling to the extent that it is related to such direct marketing;

  • The right of access by the data subject: the data subject shall have the right to obtain from the Data Controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and other specific information, pursuant to article 15 of the GDPR;

  • The right to rectification: the data subject shall have the right to obtain from the Data Controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement, pursuant to article 16 of the GDPR;

  • The right to erasure/right to be forgotten and the right of withdrawal of the consent: the data subject shall have the right to obtain from the Data Controller the erasure of personal data concerning him or her without undue delay and the Data Controller shall have the obligation to erase personal data without undue delay where the grounds set out in article 17 of the GDPR apply.   • The right to restriction of processing: the data subject shall have the right to obtain from the Data Controller restriction of processing where the grounds set out in article 18 of the GDPR apply;

  • The right to data portability: the data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to the Data controller, in a structured, commonly used, and machine-readable format and have the right to transmit those data to another data controller without hindrance from the Data Controller to which the personal data have been provided under the conditions set out in article 20 of the GDPR;

  • The right to object to marketing communications: the contractor has the right to oppose, in every moment, free of charge, to the receipt of commercial communication.

Term of purchase

1) Conditions and identity of the seller

The offer and the sale of the participation the event WMF - We Make Future 2023, presented on the website available at en.wemakefuture.it, is governed by the current general online sales conditions (hereinafter, “General Conditions”) which regulates the relationship between Search On Media Group S.r.l., VAT number 02418200800, with headquarters in via Ugo Bassi n. 7, Bologna (BO), Italy, e-mail address: info@searchon.it, (hereinafter “Search On Media Group ”), and the Client, as below defined.

In the relationships with the Client, the disposals, available in the Website (as defined below) in the General Conditions shall have application at the time of the conclusion of the contract. The General Conditions must be applied even if the sale of the participation is for free and even the entry is a gift.

The access to specific dedicated workshops shall be governed by other general conditions, available at the address /policies/#workshop

In order to manage the different phases of the booking and to have access to the digital contents eventually distributed is necessary that the User has disposal of a CRM named Master Club. The following terms and expressions shall always have, in this text, the meaning specified below, both in the singular and in the plural form:

  • Client”: shall mean any user who acquires participation in the WMF - We Make Future, accepting the General Conditions and the Contract;

  • Consumer”: shall mean any natural person acting for purposes unrelated to any business, commercial, craft or professional activity carried out;

  • Contract”: shall mean the agreement between Search On Media Group and the Client, finalized to settle their legal relationship as determined by the General Conditions and the Order Form as well as by every other information available inside the e-commerce.

  • General Conditions”: shall mean the current document;

  • Location of the Event”: shall mean all the buildings and fields in which the WMF will take place.

  • Order form”: shall mean the complementary document to the General Conditions;

  • Parties”: shall mean both Search On Media Group and the Client;

  • Participation”: shall mean the access pass to the WMF, purchased inside the Website;

  • Website”: shall mean the website available at the following address: en.wemakefuture.it, in which it’s possible to buy the Participation;

  • WMF”: shall mean the event WMF - We Make Future that takes place in Rimini on June 15-16-17, 2023.

a) For contractual purposes and/or connected to the execution of pre-contractual measures on your specific request, as well as to fulfill to eventual legal obligation related to those purposes. 12) Personal data retention period

Personal data processed and stored for all the purposes referred to in this statement are processed and stored for a period not exceeding 12 months starting from the date of the single collection;

The Owner reserves the right, in any case, to request the interested party to renew their consent to the processing and/or to verify the consents already expressed.

13) Optional nature of consent and consequences in case of lack of consent

In relation to personal data processed through technical cookies, in order to allow proper use of the web app, the communication of personal data is not a contractual obligation in relation to technical cookies, but is based on the legitimate interest of the data controller, since a fully functional web app could not be made available without this treatment. However, it is considered optional in relation to non-technical cookies. In the latter case, the failure to communicate such data will only determine the impossibility of providing a personalized service.

In relation to data provided voluntarily by e-mail, the processing of personal data is not a contractual obligation, but a treatment based on the legitimate interest of the Data Controller to reply to data subjects; without this treatment it would not be possible to reply to requests made by the data subject.

Right to object

The data subject has the right to oppose, at any time and for reasons connected with their particular situation, to the processing of personal data concerning him/her, pursuant to Article 6, paragraph,1 letters e) or f) of the GDPR, including profiling on the basis of these provisions. 1) Conditions and identity of the seller

The offer and the sale of the participation the event WMF - We Make Future 2023, presented on the website available at en.wemakefuture.it, is governed by the current general online sales conditions (hereinafter, “General Conditions”) which regulates the relationship between Search On Media Group S.r.l., VAT number 02418200800, with headquarters in via Ugo Bassi n. 7, Bologna (BO), Italy, e-mail address: info@searchon.it, (hereinafter “Search On Media Group ”), and the Client, as below defined.

In the relationships with the Client, the disposals, available in the Website (as defined below) in the General Conditions shall have application at the time of the conclusion of the contract. The General Conditions must be applied even if the sale of the participation is for free and even the entry is a gift.

The access to specific dedicated workshops shall be governed by other general conditions, available at the address /policies/#workshop

In order to manage the different phases of the booking and to have access to the digital contents eventually distributed is necessary that the User has disposal of a CRM named Master Club. The access to the Master Club is governed by different and separated general conditions, not linked, and available at the address: https://www.gtmasterclub.it/policies/#contratto

2) Definitions

The following terms and expressions shall always have, in this text, the meaning specified below, both in the singular and in the plural form:

  • Client”: shall mean any user who acquires participation in the WMF - We Make Future, accepting the General Conditions and the Contract;

  • Consumer”: shall mean any natural person acting for purposes unrelated to any business, commercial, craft or professional activity carried out;

  • Contract”: shall mean the agreement between Search On Media Group and the Client, finalized to settle their legal relationship as determined by the General Conditions and the Order Form as well as by every other information available inside the e-commerce.

  • General Conditions”: shall mean the current document;

  • Location of the Event”: shall mean all the buildings and fields in which the WMF will take place.

  • Order form”: shall mean the complementary document to the General Conditions;

  • Parties”: shall mean both Search On Media Group and the Client;

  • Participation”: shall mean the access pass to the WMF, purchased inside the Website;

  • Website”: shall mean the website available at the following address: en.wemakefuture.it, in which it’s possible to buy the Participation;

  • WMF”: shall mean the event WMF - We Make Future that takes place in Rimini on June 15-16-17, 2023.

3) Object

The General Conditions regulate the purchase of Participation to the WMF inside the Website.

Participation in the WMF can be of different types:

a.FULL - 3 DAYS

Participation within the WMF is in this case inclusive of:

  • Faculty to physically access the WMF, on all days of the event;

  • Faculty to access video recordings of all WMF speeches, where made, as well as other material published online and available within the Master Club and in the restricted area on the Official Site; This faculty will be exercisable as long as the Client keeps his/her account active within Master Club,

  • Faculty to access the online live broadcasts of the WMF scheduled for June 15-16-17, 2023 through Ibrida or another appropriate platform that will be notified through official channels.

b.FULL - 1 DAY

Participation within the WMF is in this case inclusive of:

  • Faculty to physically access the WMF on the chosen day;

  • Faculty to access the video recordings of the WMF speeches related to the chosen day, as well as the other material published online and available within the Master Club and in the restricted area on the Official Site; this faculty will be exercisable as long as the Client keeps his/her account active within Master Club,

  • Faculty to access the online live broadcasts of the WMF scheduled for the chosen day, through Ibrida or an appropriate platform that will be notified through the official channels.

c.MAIN - 3 DAYS

Participation within the WMF is in this case inclusive of:

  • Faculty to physically access all scheduled events on the WMF Mainstage, all days of the event;

  • Faculty to access the Fair Area and Theme District area every day of the event;

  • Faculty to access the web app.

d. MAIN- 1 DAY

Participation within the WMF is in this case inclusive of:

  • Faculty to physically access all scheduled events on the WMF Mainstage on the chosen day of the event;

  • Faculty to access the Trade Show Area and Theme District, on the chosen day of the event;

  • Faculty to access the web app.

e. BASIC- 3 DAYS

Participation within the WMF is in this case inclusive of:

Faculty to access the Fair Area and Theme District, all days of the event;

Faculty to access the web app.

f. BASIC- 1 DAY

  • Participation within the WMF is in this case inclusive of:

  • Faculty to access the Fair Area and Thematic District, on the chosen day of the event;

  • Faculty to access the web app.



  • 4) Access to the Master Club

To proceed with the purchase of the Participation in the Website, the Client must access the Master Club, register and conclude a separate contract, prior to registering by filling out the appropriate form available on the Website.

The Client, in any case, is required to ensure that the personal information provided during the registration process as well as subsequently, are correct, complete and truthful. The Contract will be deemed concluded when Search on Media Group receives payment from the Client.

5) Purchase of the Participation

Once access to the Master Club, the Client can proceed with the purchase of the Participation by following the procedure indicated on the Official Site and filling out the Order Form, taking care to indicate the desired number of tickets. Subsequently, the Client must read the General Conditions and print a hard copy and store a copy of it on a durable medium that allows him to keep the information that is personally addressed to him in order to access it in the future for a period of time appropriate to the purposes they are intended and that allows the identical reproduction of the stored information. If the Client has any doubts about the text of the General Conditions, he is obliged to contact the Client service and not to make any purchase Search On Media Group, at the Client's request, he can provide an electronic copy of the Contract and/or the General Conditions email address indicated by the Client. The Client must also give his consent to the processing of his personal data through one or more flags on one or more checkboxes, in accordance with the privacy notice provided.

6) Delivery of the Participation

The delivery of the Participation purchased on the Website will be online, through the Master Club service.

7) License of the multimedia contents

Search on Media Group will be able to distribute multimedia content related to WMF to Clients; the relative distribution will be the subject of a separate license agreement, available at the address: https://en.wemakefuture.it/policies/#generalConditions

8) Prices

The price of the Participation is inclusive of VAT if exposed. The price of the Participation indicated at the time of purchase, is valid until the completion of the purchase procedure. In case of cancellation of the WMF event, referred to in point 11 of the current General Conditions, the price of the Participation will not be returned to the Client. The list, available on the WMF Website, of the names of the speakers must however be considered indicative, and therefore where one or more subjects foreseen as speakers do not attend the WMF or are replaced, such non-participation or substitution, in any case, shall not be considered as the cancellation of the event unless the same event is cancelled by Search On Media Group as a whole.

9) Payment methods

The Client can pay the amount due through the following reliable and secure payment methods:

  • PayPal circuit;

  • Credit cards;

  • Bank transfer;

  • Any other means of payment indicated on the Official Site.

Search On Media Group reserves the right to vary or implement the methods of payment that can be used by the Client at any time, at its discretion. In the case of payment by credit card, the charge to the Client of the agreed price occurs after checking the credit card details and receiving the debit authorization from the company issuing the credit card, used by the Client. The data of the credit cards sent during the execution of the orders are protected and are sent directly to the banking company that manages the payments. Payments are made directly on secure server, with SSL encryption key in order to guarantee the security of the operation. In case of payment via PayPal, at the time of sending the orders by the Client, the session will be transferred to a secure PayPal site. On this site, the Client can complete the payment of the price using their PayPal account, in accordance with the conditions of use of the PayPal service signed by the Client at that time or previously. The charge of the price on the PayPal account of the Client takes place simultaneously with the sending of the order confirmation. Search On Media Group reserves the right to change or implement, at any time, the means of payment that can be used within the Official Site.

10) Access to the WMF

All Clients must have a valid identity document and an e-mail confirming the purchase, to access the WMF, the day of the event. The Participation is an access title exclusively for the edition of the WMF for which it was purchased, on the day and at the time indicated therein. Search On Media Group has the right to refuse access to the Event Site due to irregularities in the Participation and to carry out checks on the person for reasons of safety and hygiene. In the event that the Participation is found stolen, duplicated or obtained in violation of these General Conditions and/or legal terms, the holder of the Participation may not be authorized to access the place of the Event or may be obliged to leave it. During the participation each User is required to show an identification card provided by the organization.

11) Information about the Participation/postponement and cancellation of the WMF

In order to make Participation clear and transparent, the program and the necessary information relating to the WMF event are made available on the Website. The list of the speakers, of the WMF side initiatives, of the sponsors, of the exhibitors, is merely indicative. The organization reserves the relative variation at any time. The choice of the place and its dates may be subject to change. In the event that the WMF is canceled by Search On Media Group, the Client will have the right to send the Organizer a request for reimbursement according to the methods and timing established by them. In the event that the WMF is returned by Search On Media Group, the Client will not be entitled to any refund but will have the right to participate in the event on the new dates indicated. In the event of cancellation due to reasons of public safety or force majeure, which can be assessed as such by Search On Media Group, the right to reimbursement is expressly excluded. Any other guarantee is expressly excluded.

12) Dissimilarities between the Participation received and the purchased one

Without prejudice to the provisions of the aforementioned articles, in all cases of discrepancy between the Participation and the purchased one, the Client may contact Search On Media Group, at the addresses expressed in at point 1 of the General Conditions.

13) Restrictions to the Participations

The Participations shall not be resold, whether for payment or free, without the express consent of Search On Media Group and in any case in the event that Search On Media Group specifically prohibits the transfer of ownership on the basis of the principles of nomination. Furthermore, the Participations cannot constitute the prize for prize events, which fall within the scope of application of Presidential Decree 430/2001 or of other reward or promotional initiatives (such as, for example, competitions or lotteries), except for the prior written authorization issued by Search On Media Group.

14) Claims

15) Withdrawal right

The Client, once the contract is concluded, cannot in any way withdraw from the same, without prejudice to the legal limits. In particular, the Client cannot ask for the reimbursement of the tickets, when not using the participation.

16) Contract release

Search On Media Group may substitute for itself a different subject and/or assign and/or subcontract this Contract in any way, in whole or in part, at any time and without any prior notice or communication obligation to the Client.

17) Limitation of liability

Search On Media Group cannot be held responsible for any expenses and damages, direct and indirect, of any nature, suffered by the Customer in relation to the execution and/or failure and/or inexact execution of the Contract and/or participation of the Customer at WMF. Search On Media Group will be held by the Customer, indemnified and free from all damages and expenses, penalties, and in general, from any obligation to pay money, due to activities directly or indirectly related to the fulfilment of the Contract. The Customer also waives as of now on any request, claim, or civil action, even for economic reasons and/or compensation for damages, against Search On Media Group directly connected to the failure and/or inexact fulfilment of the Contract. Search on Media Group will not be held responsible for any theft or loss of money, materials or goods occurring within the event. This clause is not implemented in cases of wilful misconduct or gross negligence. 18. Privacy – The Client shall take vision of the information to the data subject, according to the current legislation, including the General Data Protection Regulation 679/2016, available on the Website at the address: https://en.wemakefuture.it/policies/#purchaseConditions

18) Governing law and competent jurisdiction

The Contract is governed by Italian law. The Court of Milan shall have exclusive jurisdiction over any dispute connected with the interpretation and the performance of the Contract.

19) Amendment of the General Conditions

The General Conditions may be subject to modifications, at any time, by Search On Media Group.

The Data Controller shall process the personal data related to data subject which apply in order to be appointed as journalist during the event (hereinafter “WMF" / "We Make Future”), as defined by the current discipline about personal data protection. The Information to Data Subject is also accessible at the Data Controller headquarters. If expressly requested by the Data Subject, the information indicated herein may also be provided orally, provided that the identity of the applicant is proven, by means of a telephone request.

The Data Controller is Search On Media Group S.r.l., in the person of the pro tempore CEO.

Since the Data Controller is located in Italy, there is no need to appoint a representative.

3) Information to Data Subject on the processing of personal data carried out by means of Web and third-party data

4) Third-party data

Before providing materials containing personal data of third parties, you shall necessarily provide the abovementioned third party with the current Information to Data Subject and inform him that his personal data shall be processed as herein established, requesting the necessary consent, in accordance with the current legislation.

5) Purposes of the processing and legal basis

The personal data shall be processed for the following purposes:

a. For contractual purposes and/or purposes connected with the execution of pre-contractual measures adopted on your specific request, and for purposes related to the participation as journalist for the Event, compliant with the related offers for the public, who shall access to the present information. In this case, the legal basis is the need to proceed with the processing in order to execute the contract and/or to manage pre-contractual relations. In relation to personal data processed and stored for this purpose, the communication of personal data is not a contractual obligation. The Data Subject has the right to provide personal data; however, in case of failure to communicate such data it shall not be possible to participate as a journalist;

b. For the purposes connected to related legal obligations, whenever a data processing for the purposes of letter a) has been carried out. In this case, the legal obligation of the Data Controller to process those data according to the applicable national law provides the legal basis. It is mandatory to provide such personal data; however, in case of failure to communicate such data it shall not be possible to participate as a journalist.

6) Modalities for providing the consent

The consent, whenever requested, could be given by signing a digital document, also by a specific flag box.

7) Modalities of treatment and logic

In relation to the personal data, processed and retained for the purposes referred to in point a), number 5 of the current information on data subject (contractual and pre-contractual purposes) and point b), number 5, the processing will be carried out by paper means, by automated means and through the use of CRM management software – Master Club managerial system included – which allow a better contractual obligations fulfillment. In any case the personal data shall be shared inside of the communication’s telematic networks, including Internet and social network, also in order to make the sponsorship public.

8) The source of personal data

Only the data provided in the respect of the current information to data subject, collected by specific form, more precisely data collected during the event to which the present information is related, will be processed.

Personal Data originated by other sources accessible to the public shall not be processed.

9) The recipients and eventual categories of recipients of personal data

The recipients of your personal data may be:

  • companies that offer services of an information society, including, in particular, those offering hosting services;

  • partner companies of the event;

  • auditing companies.

10) Categories of data

The data subject’s personal data will be processed. In any case, particular data (e.g.: data related to the state of health of a person) shall not be processed.

11) Transfer of data

The Data Controller may intend to transfer personal data to a third country or to an international organization. Such subjects may be:

  • Communication companies that conduct a communication activity on behalf of the Data Controller;

  • Suppliers of services for the communication company;

  • Controlled organizations and/or controllers.

The transfer of personal data to the aforementioned subjects, if based in a third country or international organization, is carried out according to a decision of suitability of the European Commission, which evaluates how the third country, the territory or one or more specific sectors in the third country or the international organization ensure an adequate level of protection of the data subject’s rights. In the absence of such decision, the Data Controller – if deemed in any case appropriate – reserves himself the right to conclude specific separate agreements that oblige such subjects to adopt adequate security and also organizational measures, in order to offer appropriate guarantees related to the data subject’s rights. In order to obtain a copy of those data or the place where they are made available it is possible to send a request to the Data Processor, at the above-mentioned addresses.

12) Personal data retention period

The personal data processed and retained for the purposes referred to in letter a) and b), number 5 of the current Information to Data Subject (contractual and pre-contractual purposes) are processed for a period of time not exceeding 10 years from the send of the request, unless otherwise provided by law.

13) Right to object

The data subject has the right to object in the circumstances listed hereinbelow:

  • At any time, in relation to reasons related to your particular situation, to oppose to the processing of personal data concerning yourself, according to point (e) or (f) of Article 6(1) of the GDPR, including profiling based on those provisions. The Data Controller shall no longer process the personal data unless the Data Controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims;

  • Where personal data are processed for direct marketing purposes, you shall have the right to object at any time to processing of personal data concerning yourself for such marketing, which includes profiling to the extent that it is related to such direct marketing;

  • Where you object to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes;

  • Where personal data are processed for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) of the GDPR, you, on grounds relating to your particular situation, shall have the right to object to processing of personal data concerning yourself, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

The Data Controller shall also inform the data subject about the existence of the following rights:

  • The right of access by the data subject: the data subject shall have the right to obtain from the Data Controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and other specific information, pursuant to article 15 of the GDPR;

  • The right to rectification: the data subject shall have the right to obtain from the Data Controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement, pursuant to article 16 of the GDPR;

  • The right to erasure/right to be forgotten and the right of withdrawal of the consent: the data subject shall have the right to obtain from the Data Controller the erasure of personal data concerning him or her without undue delay and the Data Controller shall have the obligation to erase personal data without undue delay where the grounds set out in article 17 of the GDPR apply.   • The right to data portability: the data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to the Data controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another data controller without hindrance from the Data Controller to which the personal data have been provided under the conditions set out in article 20 of the GDPR.

4) Purposes and legal basis of the processing, consent of the data subject and consequences of a lack of consent

Personal data of the data subject shall be processed for the following purposes:

a. To send marketing communications on the events organized by the Controller, such as WMF - We Make Future, Social Media Strategies, Search Marketing Connect. In such case, the consent of the data subject, given in accordance with the Information, provides the required legal basis for the processing of his/her personal data. Due to the purpose of the processing, the data subject is not contractually bound to give consent. In case of a lack of consent, however, the Controller will not be able to send any updates nor communications to the data subject.

The data subject shall give his/her consent by clicking on a specific checkbox.

6) Method of data processing

With regard to personal data processed for the purpose referred to in point 3) of the Information (Marketing), the processing is carried out via email, by way of paper means, automated means and through the use of CRM management software - such as Masterclub - to manage the effective delivery of marketing communications. In no event personal data will be shared by the Controller within communication networks.

7) The source of collected personal data

The Controller will only process personal data given by the data subject in accordance with the Information and collected through a specific form.

8) Recipients or categories of recipients of the data subject’s personal data

The following subjects shall be the recipients of the data subject’s personal data:

  • Marketing companies or agencies providing professional marketing services, such as email marketing services, on behalf of the Controller in the role of processors;

  • Companies belonging to the information society, such as those providing web hosting services.

9) Categories of personal data

The Controller shall only process personal data of the data subject. In no event, special categories of data, such as those concerning health, shall be processed.

10) Transfer of personal data to third countries or international organizations

The Controller may intend to transfer personal data to a third country or an international organization, such as:

  • Communication agencies conducting activities on behalf of the Data Controller;

  • Controlling and/or controlled undertakings of the Controller.

The transfer of personal data to the aforesaid subjects is subject to an adequacy decision made by the European Commission after deciding that the third country or one or more specified sectors within that third country, or the international organization in question, ensures an adequate level of protection of personal data. However, if the Controller deems it appropriate to proceed with the transfer of personal data despite the lack of any adequacy decisions, he reserves himself the right to conclude separate agreements with those subjects, requiring them to adopt adequate security measures to safeguard the transferred personal data. Personal data processed and stored for the purposes referred to in point 3) of the Information (marketing), are processed and stored until the data subject demands the Controller to proceed with their erasure.

The data subject is granted the right to object for the following motives:

  • The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions. 2The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.
